MDMK leader Vaiko and the head of Tamizhar Desiya Iyakkam Nedumaran will be freed on bail. They were arrested Wednesday after they demanded that Sri Lanka's diplomatic offices in Chennai should be shut down.
The two leaders are seen as sympathetic to Sri Lanka's minority Tamil's and opposed to President Mahinda Rajapakse.
Vaiko and Nedumaran were arrested in Chennai when they led a protest to condemn the death of a fishermen from Tamilnadu who died at mid-sea reportedly after an attack by the Sri Lankan navy.
Protestors burnt effigies of President Mahinda Rajapakse who they consider as a butcher of the Tamils.
Attacks and seizure of Tamilnadu's fishermen by the Sri Lankan navy is a long-running issue.
Sri Lanka and India say each other's fishermen are arrested when they stray into their territorial waters while fishing close to the international maritime boundary.
